Rules for the operation of beaches in Odesa are no longer in force

The rules for the equipment and operation of beaches established earlier by the Odesa City Council have lost their relevance due to changes in legislation.

The decision was made by the deputies of the Odesa City Council at its session on November 19.

The Law of Ukraine "On Lease of State and Communal Property" no longer allows beaches to be leased as landscaping facilities or hydraulic structures, as was done under the City Hall's rules of 2007.

Now beaches can be leased only as land plots of the water fund - through open land auctions. The rent is higher, and it is forbidden to build anything on the beach. That is, entrepreneurs can provide services such as renting deck chairs, but not install fences, bungalows, or any kiosks on the beach.

The city council will not develop new rules for beach equipment - the issues of maintenance and operation of the city's beaches will be regulated in the new Rules for the improvement of the territory of Odesa, which are currently being developed.

However, this does not mean immediate termination of agreements with entrepreneurs with whom agreements have already been concluded, as some of these agreements have not yet expired. Therefore, as explained by Inna Popovska, Director of the Legal Department of the City Council, they can be terminated either if one of the parties fails to fulfill the terms of the agreement or if the agreements are recognized as "imaginary". These agreements are based, in part, on the old rules of beach use. In particular, entrepreneurs who rented the beach area had to leave 30% of the territory for free use - no sunbeds or bungalows were allowed. They also had to provide a passage along the water at least five meters wide.

According to a representative of the prosecutor'soffice, the courts are currently considering 30 lawsuits filed by the agency to terminate beach lease agreements.
