Antimonopoly Committee claims that utilities in Odesa region are abusing their position

The Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine stated that Kremydivska Hvilya, Comfort and Zelenohirskkomunservice had concluded contracts with consumers for the provision of centralized water supply services that did not comply with the terms of standard contracts approved by a resolution of the Cabinet of Ministers of Ukraine.

This was reported by the AMCU press service.

In addition, according to the antitrust authorities, KP Comfort also failed to bring the existing contracts for the provision of centralized water supply services concluded with consumers in line with the terms of the current version of standard contracts for the provision of such services.

As a result of actions taken by Kremidivska Hvilya, Comfort and Zelenohirskkomunservice in the form of using contracts in a version that does not comply with the provisions of the current legislation, as well as actions on the part of Comfort in the form of not bringing the contracts in line with the current provisions of the legislation, the scope of consumer rights, obligations of service providers and their liability for violation of the terms of such contracts has been reduced, which may lead to violations of the rights and interests of consumers.

On June 12, 2025, the administrative board of the AMCU's Southern MTV provided the said utilities with mandatory recommendations to cease actions or omissions containing signs of violation of the legislation on protection of economic competition under Article 50(2) and Article 13(1) of the Law of Ukraine "On Protection of Economic Competition" in the form of abuse of monopoly (dominant) position in the market by concluding contracts with consumers in accordance with the requirements of the current version and informing them of the terms of the contracts.
