AMCU reveals collusion in bidding for Kherson sports school

The collusion of two private entrepreneurs who have already ceased their activities was revealed by the AMCU employees during a tender in Kherson region.

This was reported by the press service of the AMCU.

The report says that the administrative board of the Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine established the existence of collusion between the sole proprietor Ulida A.V. and the sole proprietor Demydenko E.M. during their preparation and participation in open bidding for the purchase of "boats". The bidding was conducted by the Children's and Youth Sports School "Spartak" of the Kherson City Council and the municipal institution "Kherson School of Higher Sportsmanship" in 2017.

It is noted that, based on the results of the case, the Department established a number of facts and circumstances that, taken together, indicate the coordination of the behavior of these participants during the preparation and participation in the bidding, contrary to the Law of Ukraine "On Public Procurement". Therefore, the administrative board of the Southern MTV recognized the actions of individual entrepreneur A.V. Ulida and individual entrepreneur Y.M. Demydenko as a violation under Article 50(1), paragraph 4 of Article 6(2) of the Law of Ukraine "On Protection of Economic Competition" in the form of anticompetitive concerted actions related to the distortion of bidding results.

The press service added that due to the termination of business activities of individual entrepreneur A.V. Ulida and individual entrepreneur Y.M. Demydenko and taking into account the provisions of the legislation on protection of economic competition, it is impossible to impose fines on such participants. At the same time, they reminded that according to the Law of Ukraine "On Public Procurement", the grounds for refusal to participate in the procurement procedure is the fact that the business entity has been held liable for committing anticompetitive concerted actions related to the distortion of tender results over the past three years.
