Resident of Odesa region convicted for unauthorized dumping of fuel oil from ships at landfill

The Izmail City District Court of Odesa Region approved a plea agreement between a resident of the region and the prosecutor on the man's guilt in land pollution and abuse of power.

As stated in the court' s verdict, the man agreed to participate in the activities of a group consisting of entrepreneurs who, by using their official powers, being officials contrary to the interests of these legal entities, carried out illegal activities to collect hazardous shipboard liquid waste and then illegally dump it on the land plot of a solid waste landfill in the territory of Safianivka village council of Izmail district of Odesa region.

Having no permits for hazardous waste management and no relevant facilities, the group's organizer invented a way to cover up the illegal activity by entering into an agreement with a hazardous waste management licensee, the parties to which did not proceed to its execution because he did not send the counterparty a signed copy.

The convict did not directly act as part of an organized group, but he aided and abetted the entrepreneurs in abuse of office by providing means - his own documents (passports of Ukrainian citizens, driver's licenses) to the director of the Agency Company for issuing passes for the company's road transport to enter the port of Izmail.

For the removal of ballast water from the holds of ships and loading of oily water (hazardous waste) into sewage trucks, further transportation of hazardous waste (these actions were the subject of the transactions, i.e. without the drivers entering the Port, washing the holds, loading the vehicles, removing and dumping them on the landfill site.

This caused a significant deterioration of the environment and caused material damage to the environment in the amount of UAH 4 million 173.9 thousand.

The defendant was sentenced to three years in prison with a two-year disqualification to engage in waste management activities. However, the court released him from serving the main sentence with probation for one year.
