Odesa-based firm wins the same tender in Chornomorsk for the fifth time without an auction

For the fifth time, the Capital Construction Department of the Chornomorsk City Council of Odesa Oblast has held a tender to select a contractor to install a gas-piston cogeneration unit with a capacity of more than 1 mW at the boiler house of the Chornomorskteploenergo utility company.

The relevant announcement was published in the Prozorro electronic procurement system.

Like the previous ones, the procurement was conducted in the format of open bidding with special features, and Pivdenenergomontazh Limited Liability Company had no competitors. However, this time there was a nuance - the procurement was carried out under an adjusted project, which has risen in price to UAH 45 million 462 thousand, which the company expects to receive if the deal is concluded.

According to the YouControl service, Pivdenenergomontazh LLC was registered in 2017. The ultimate beneficiaries are Andriy Onishchenko from Zaporizhzhia and two Odesa residents, Andriy Shcherbin and Mykola Zabrodtskyi.

The company won the previous procurement in January 2024. At that time, the price was UAH 38 million 449 thousand, but in the end, according to Prozorro, after concluding a number of additional agreements, the company received UAH 8 million 836 thousand, and the project was adjusted.

The previous procurement was held in October 2023. Then the company won the right to build this boiler house for UAH 37 million 822 thousand without an auction. But in the end, the agreement was terminated by mutual agreement of the parties based on the conclusion on the results of monitoring the procurement procedure.

This was the third attempt to hold this auction. The second procurement took place on October 11, 2023, but on October 18, the company was rejected and the tender was recognized as not taking place due to the lack of proposals.

The rejection protocol stated that the participant of the procurement procedure

indicated in the tender proposal inaccurate information that is essential for determining the results of open bidding;

• failed to provide a tender offer security, if such security was required by the client;
• failed to correct the discrepancies in the information or documents submitted by the procuring entity as part of its tender proposal after the tender proposal disclosure, and changed the subject of procurement (its name, brand, model, etc.) while correcting the discrepancies identified by the procuring entity, within 24 hours from the moment the procuring entity placed a notice in the electronic procurement system requiring the elimination of such discrepancies;
• failed to provide justification for an abnormally low tender price;
• designated as confidential information that cannot be defined as confidential.

The commission also points to other inconsistencies in the documentation.

In September of the same year, the company won this tender for the first time, but due to a number of problems with the documents, the company's proposal was rejected and the tender had to be canceled due to the lack of proposals
