In Mykolaiv Oblast, authorities are seeking to reclaim illegally leased properties worth nearly 30 million

The prosecutor’s office is seeking a court order to return to the community in the Pervomaiskyi District the hydraulic structures that were leased in violation of the law. Their value amounts to 28.9 million hryvnias.

This was reported by the Mykolaiv Regional Prosecutor’s Office.

The Pervomaisky City and District Court has opened proceedings on a lawsuit filed by the district prosecutor’s office. The lawsuit was filed on behalf of the village council against an individual.

The case concerns hydraulic structures in the village of Dovha Prystan, Sinyukhynobridskyi Village Council, Pervomaiskyi District.

Prosecutors determined that the man obtained the right to use the water facility in violation of established procedures. No competitive bidding process was held for the lease rights, the agreement was not notarized, and it was not registered with state authorities.

Hydraulic structures are engineering facilities designed for the use of water resources or for protection against the harmful effects of water. According to the regulatory framework, these include dams, spillways, canals, locks, and shoreline reinforcement structures.

Such violations render the lease agreements null and void under the law. This means they are invalid from the moment they were signed.

Consequently, the individual has been using the property all this time without any legal basis.

To protect the community’s interests, the prosecutor filed lawsuits in court. The goal is to return the hydraulic structures to the local community’s control.

Previously, Intent reported on how land belonging to the Water Fund near the Dniester River had effectively been developed as a resort area. The court authorized a re-inspection of the plot in a case involving suspicions of document forgery and violations of land use regulations.
