Instead of supplementing the information in the terms of reference for the overhaul of the shelter in Pershotravneve village, theVyzyr village council in Odesa region advised the potential bidder to visit the construction site and make the calculations themselves.
According to the Center for Public Investigations, the auction with an expected purchase price of UAH 6 million 442 thousand was held on September 16 in the format of open bidding with special features, and the winning company will have to complete the repairs by December 31, 2025.
The CPR notes that before the start of the tender, at the stage of submitting documents, a potential participant asked the customer to "provide a nomenclature (list) of materials and equipment, a list of resources, or approved project documentation" because this was not in the terms of reference.
"According to such terms of reference, it is impossible to make a qualitative calculation of the contractual price of the proposal," the potential participant wrote.
However, the customer invited him to<i>"inspect the construction site in order to identify problems that may arise on the construction site (unforeseen soil conditions, the presence of communications and structures not shown on the master plan, etc. </i>
At the same time, the customer noted that this was not a discriminatory condition, as it was not spelled out in the terms of reference and hinted that the participant was not entirely honest.
<i>"It is not a difficult task for all participants who work efficiently and in good faith in the construction sector to calculate the price offer. There are no requirements for "inspection (survey) of the object of service provision..." The customer did not set any requirements in the tender documentation.</i>
As a result, only one participant came to the auction - the private enterprise Yuzhspetstrade. It offered to fulfill the contract for UAH 6 million 439 thousand. And since there was no competition, the contract was signed with it.
According to the CPLR, the contractor submitted the contract price and several calculations from the estimate. However, these were calculations of profit, administrative expenses and equipment costs. The main estimate for material resources was not in the documents. They account for 70% of the contract value, and it is the materials that may be overpriced.
