The case of Kivan's death was returned to Odesa for consideration on the merits

The National Police has completed an investigation into the case of Vitaliy Rusakov, a doctor at Odrex private hospital, who is suspected of negligence in the treatment of Odesa businessman Adnan Kivan, which led to the patient's death.

"I have been served with an indictment and the case is returning to Odesa. The trial on the merits is ahead. You can make a case loud, but you can't make the truth quiet. The facts remain and will be investigated in an open court. And they will put the final point. I know one thing for sure - I am innocent in this case. I did everything possible for the patient - just as I have done and do it every day in my profession," he wrote.

Before that, the case was considered by the Pechersk Court of Kyiv and the Kyiv Court of Appeal. In December 2025, the latter refused to grant the petition of the lawyers of Vitaliy Rusakov, a doctor at the Odrex private hospital, and allow him to continue his medical practice.

In November, the Kyiv Court of Appeal partially granted the motion of the lawyers of Vitaliy Rusakov, who is suspected of negligence during the treatment of Odesa businessman Adnan Kivan, which led to the patient's death.

Earlier, the lawyers of Odesa doctors, who were tried for alleged medical malpractice after the death of cancer-stricken millionaire Adnan Kivan, claimed an attempted raider seizure by law enforcement.

The businessman died on October 28, 2024, at the age of 61 as a result of a long-lasting cancer. In Odesa, he was known as the owner of the KADORR Group company, the Kyiv Post and Ukrainian Information Service publications, and Channel 7. He was included in the list of the 100 richest Ukrainians and the five largest renters with a fortune of $240 million according to Forbes. Adnan Kivan was also listed as an offshore owner in Bahamas Leaks.

Almost a year later, on October 25, 2025, two doctors at the private Odrex hospital were notified of suspicion of improper performance of professional duties in connection with his death. According to the police, investigators have gathered enough evidence to confirm the causal link between the improper actions of medical professionals and the patient's death.
