The Odesa Regional Prosecutor's Office commented on the statements of Dacha restaurant owner Sava Libkin regarding the alleged raider seizure of the establishment. The agency emphasized that their actions are aimed solely at protecting the interests of the state and are not intended to put pressure on business.
This is stated in the official statement of the prosecutor's office.
"While the Russian fascists are burning down the best places in Dnipro, the Ukrainian prosecutor's office is killing the same place, the Dacha restaurant in Odesa," Libkin wrote.
According to the documents, the Dacha restaurant is located on the territory of the Chkalov State Sanatorium, whose park has the status of a monument of landscape art. In 2004, Drive-In LLC leased a 195 m² space, which was later expanded to 350 m². In 2018, the company acquired a part of the 350 m² building through a sale and purchase agreement with the Regional Office of the State Property Fund of Ukraine. However, according to the law, cultural heritage sites are not subject to privatization.
In 2021, the prosecutor's office filed a lawsuit demanding that the agreement be declared invalid and the property returned to the state. After reviewing the case, in June 2024, the Supreme Court overturned the decisions of the previous instances that dismissed the claim and sent the case for a new trial.
In addition, the 0.7692-hectare land plot on which the restaurant's summer terrace and other facilities are located is being used without proper legal grounds. In September 2024, Drive-In LLC filed a lawsuit to recognize the right to use this land plot, but after the intervention of the prosecutor's office, the lawsuit was left without consideration. In March 2025, the company filed a similar lawsuit, and the prosecutor's office is considering re-entering the case.
In February 2025, the sanatorium filed a complaint with the police about the unauthorized seizure of the land plot, which led to the opening of criminal proceedings under the relevant article of the Criminal Code of Ukraine.
The prosecutor's office emphasized that their actions were aimed at protecting the interests of the state and were not related to pressure on business activities. No measures were taken to stop or block the restaurant's operations.
Recently, Intent wrote that the regional office of the State Property Fund offers for rent the premises of the children's specialized sanatorium Khadzhibey in the resort area of Odesa region. The starting rent is just over UAH 3 thousand per month.
