Odesa Court Invalidates Land Lease Worth ₴800K Due to Law Violations

The Economic Court of Odesa Oblast has invalidated a lease agreement for 46 hectares of land with water bodies in the village of Vesele, Novokakhovka community. The land, worth UAH 800,000, was leased by a private enterprise, but the transfer took place in violation of the law.

This was reported by the Kherson Regional Prosecutor's Office.

The Beryslav District State Administration transferred the land to the company along with ponds for fisheries without holding a mandatory auction. In addition, the agreement did not contain a cadastral number, which made it impossible to calculate the rent correctly.

Following a lawsuit filed by the Kakhovka District Prosecutor's Office, the court invalidated the agreement and ordered the company to return the land to the state. The decision has entered into force, and the prosecutor's office will monitor its implementation.

Recently, the court terminated a lease agreement and ordered a private company to return 234 hectares of land to the state, as well as hydraulic structures of a fishery reservoir on Lake Solonets in Kherson region.

Earlier, prosecutors of the Kherson Regional Prosecutor's Office defended in court the state's right to forest land plots with a total area of more than 42 hectares.

Also, with the intervention of the prosecutor's office, 80 hectares of land worth almost UAH 2 million were returned to the Kherson community. One of the companies leased the land for production activities related to landscaping in Kherson and the region. However, contrary to the current legislation and the terms of the agreement, the lessee did not pay the rent during 2022-2024, owing money to the local budget.

The Oleshky District Prosecutor's Office ordered the local government to organize the work on the delineation of the boundaries of the natural reserve fund object - the Sofiyivsky Botanical Reserve of local importance. In addition, the prosecutor's office protected the lands of the Oleksandrivskyi Nature Reserve Fund from illegal use.
