Mykolaiv Court Invalidates ₴1.4M Loader Contract for Quality Issues

A Mykolaiv court invalidated a contract for the purchase of a telescopic loader that did not meet the requirements and ordered a refund. A utility company in the Bashtanka region spent almost one and a half million for low-quality vehicles.

This was reported by the press service of the Mykolaiv Regional Prosecutor's Office.

The Economic Court of Mykolaiv Oblast upheld the claim of the Bashtanka District Prosecutor's Office, which acted in the interests of the state and local authorities, and invalidated the contract between the utility company and a private entrepreneur for the purchase of a telescopic loader.

It turned out that the utility company purchased the loader for UAH 1.4 million through a public procurement, but it did not meet the technical requirements: it did not meet the year of manufacture, service life, and standards for localization of production in Ukraine.

According to the court's decision, the entrepreneur must return the money received for the forklift, and the utility company is obliged to return the goods. This decision will help the government better control budget spending.

In Mykolaiv, the head of a private company and a technical supervision engineer are accused of embezzling almost UAH 39.5 million during the construction of a pontoon bridge. The Southwestern Commercial Court of Appeal upheld the prosecutor's claim and ordered the return of state property worth UAH 2 million.

The prosecutor's office also challenged supply agreements to social institutions due to collusion of entrepreneurs in Mykolaiv region and demanded a refund. They are accused of manipulating the bidding process and distorting the procurement results.

Recently, the court canceled an agreement with a contractor who did not start construction of a stadium despite the allocation of more than UAH 17 million. The Department did not take appropriate measures to monitor the fulfillment of the contract, which indicates ineffective management of budget funds during martial law.
