In the Odesa region, Gazprom's 3-billion-dollar debt has been put up for sale

Arbitration administrator Oksana Venska has put up for auction a claim totaling 3 billion 813 million 137 thousand hryvnias owed to the "SY Zhnyva" farming enterprise in Odesa.

Oksana Venska published the corresponding announcement on the Prozorro.Sales platform.

The farmers’ debtors turned out to be: PJSC “Gazprom,” LLC “Gazprom Capital,” and the international company LLC “Gazprom International Limited,” all of which are part of the Russian company “Gazprom.”  The farming enterprise itself is currently undergoing bankruptcy proceedings. The Ukrainian company justified its claims by stating that due to the full-scale invasion, it lost grain—wheat, corn, and sunflower seeds—worth 3.8 billion hryvnias, which were located in the Zaporizhzhia region. According to the Zaporizhzhia Investigative Center, as of February 2024, this company’s losses accounted for 71% of the total losses recorded by businesses in the Zaporizhzhia region. 

A claim is a type of property right under which a creditor has the legal right to demand that a debtor fulfill certain obligations (payment of funds, transfer of property, performance of work, or provision of services).

 According to the YouControl service, the limited liability company "SY "Zhnyva" was registered in Odesa in 2019. The owner is Kyiv resident Kostyantyn Skrypnychenko.

As a result of the Russian Federation’s occupation of territories in the Zaporizhzhia and Kherson regions, the “SY Zhnyva” farming enterprise suffered losses amounting to 3.8 billion hryvnias. The losses resulted from the loss of grain belonging to the enterprise, which was stored in granaries in the occupied territory and was looted or spoiled after the occupation. The company filed a lawsuit with the Commercial Court of Zaporizhzhia Oblast seeking compensation for damages from the Russian Federation. In February 2023, the court issued a ruling recognizing the Russian Federation’s liability and ordering it to compensate for the losses incurred by “SY Zhnyva.” In June 2024, the farm initiated new proceedings in the same court against Gazprom and a number of its affiliates, demanding, on the basis of the doctrine of joint and several liability, that the defendants be held jointly liable with the Russian Federation for the damages caused. In August 2024, the court, guided by this doctrine, recognized Gazprom and its affiliated companies as alter egos of the Russian Federation and imposed on them a joint and several obligation to compensate for the damages caused to “SY Zhnyva” by the actions of the aggressor state.

Subsequently, “SY Zhnyva” filed a petition with the District Court of The Hague seeking recognition and enforcement of the judgment against Gazprom within the territory of the Netherlands, seeking to enforce the judgment against Gazprom’s shares in Wintershall and Gazprom International Projects. On June 5, 2025, the District Court of The Hague issued a ruling in which it declared itself incompetent to hear "SY Zhnyva’s" application due to the Russian Federation’s sovereign immunity and refused to recognize and enforce the Judgment against Gazprom in the Netherlands.
