Border guard convicted in Izmail chose the front instead of prison

The border guard, who was sentenced to five years in prison by the Izmail court in Odesa region for refusing to go to the front, is preparing to sign a contract for military service.

This was reported by the Bessarabia INFORM media outlet, citing its sources.

In July, the Izmail City District Court of Odesa Oblast found a border guard inspector who served under contract in Izmail guilty of disobeying orders and sentenced him to five years in prison.

The soldier received an order to leave Izmail for the Kursk military base, but did not comply with the order. He verbally told his commanders that he refused to comply with this order, so his actions were qualified as insubordination, i.e. an open refusal to obey an order of a superior, committed under martial law. Given that it was paragraph 4 of Article 402 of the Criminal Code of Ukraine, the military man received the lightest punishment provided for by this paragraph of the article, with a maximum of 10 years in prison.

During the internal investigation, the sergeant explained his refusal by saying that he was not ready to die and leave his two children half-orphaned. There were no further violations of military discipline on the part of the soldier.

In January, a man from Podilsk, Odesa region, did not come to the MCC and JIC because he was afraid of serving in the army. However, the court did not accept his arguments and found him guilty of evading mobilization. A citizen who is liable for military service received a call on June 20, 2024, and was obliged to report to the CCC and JV for service. However, despite the fact that he personally signed the receipt of the call and was warned of criminal liability for evasion, he did not report for service on June 22, 2024, without good reason.
