Prosecutor's Office in Odesa refused to arrest transshipment complex

In Odesa, the state and a private company are locked in a legal battle over a transshipment complex on Mytna Square. The prosecutor's office tried to seize the buildings, but the court refused to arrest them.

This is evidenced by the ruling of the Economic Court of Odesa Region.

The court denied the deputy head of the regional prosecutor's office's request to secure a claim against Prista Oil-Ukraine LLC. The state tried to seize the transshipment complex on Mytna Square in Odesa and prohibit any registration actions in relation to buildings with an area of more than 1,600 square meters.

The prosecutor's office filed the lawsuit in the interests of the state through the State Property Fund and the Ministry of Community and Territorial Development. Law enforcers claimed that the company had illegally registered ownership of a part of the state property that was previously in use under a lease agreement. The prosecutor's office also demanded that the company vacate some of the areas and dismantle the facilities on the territory of the complex, which, in their opinion, were being used without legal grounds.

The court found that the actual owners of the disputed buildings are: 954/1000 shares are owned by Prista Oil-Ukraine, and the remaining 46/1000 shares are owned by Odesa Port Operator LLC. The court noted that the seizure of the complex could make it difficult or impossible to enforce any future court decision, especially if the property is re-registered to third parties.

The judge denied the prosecutor's request for interim relief, but the prosecutor's office may appeal to the Southwestern Commercial Court of Appeal.

The court in Odesa also demanded documents in the case of the Lanzheron artificial beach and resumed consideration of the lease agreement. The prosecutor's office insists on returning the territory to the community, arguing that the agreement is a sham because the beach is located in the coastal protection zone and its lease violates land legislation.
