Odesa extends nightly house arrest for Odrex doctors over Kivan's death

In Odesa, a court has left the head of surgery and an oncologist under nightly house arrest, who are accused of the death of businessman Adnan Kivan. The investigation found that the improper performance of professional duties by the doctors caused his death.

The Prymorskyi District Court of Odesa has extended the nightly house arrest for Vitalii Rusakov, head of the surgical department, and Maryna Belotserkovska, a former oncologist at the private Odreks clinic. They are accused of improper performance of their professional duties, which led to the death of a patient, Adnan Kivan.

At the hearing on January 28, Rusakov 's lawyer tried to have the prosecutor recused, but the court denied the motion. At the same time, the prosecutor asked to extend the pre-trial restraint for both defendants for another two months and to keep the doctor suspended from his position as head of surgery, which the court upheld. The next preparatory hearing to consider the merits of the indictment is scheduled for February 16.

The Odrex scandal erupted after the death of local businessman Adnan Kivan, who was treated there from May to October 2024. Following his death, two doctors were notified of suspicion of improper performance of professional duties (Part 1 of Article 140 of the Criminal Code of Ukraine).

According to the conclusions of the examination, the actions of the accused caused Kivan's death. In particular, the surgeon did not prescribe antibiotics to the patient after the operation and ignored the obvious signs of sepsis, which could have led to death.

Last year, the Prosecutor General's Office demanded that Odrex 's license be revoked because of the death of Odesa businessman Kivan. On November 20, after a second request, the Ministry issued an order for an inspection.

Odesa businessman Adnan Kivan died on October 28, 2024, at the age of 61, as a result of a long-lasting cancer. In Odesa, he was known as the owner of the KADORR Group company, the Kyiv Post and Ukrainian Information Service publications, and Channel 7. He was one of the 100 richest Ukrainians and the five largest rentiers with a net worth of $240 million according to Forbes.

Recently, representatives of the Odrex clinic announced systematic and disproportionate pressure from law enforcement agencies with the participation of officials from the Prosecutor General's Office. in this regard, the clinic publicly appealed to the Prosecutor General of Ukraine Ruslan Kravchenko with a demand to take the situation under his personal control.
