Mykolaiv Court Seizes ₴5M in Property Over TOKA LLC Dispute and Illegal Mining

In Mykolaiv region, a court ordered the seizure of property. The case concerns the seizure of funds and agricultural machinery that was allegedly taken from the company illegally.

According to the court order, TOKA LLC was founded on April 23, 2020. Already in 2020, the victim bought out a 60% share in the authorized capital, and another person acquired a 40% share. In March 2021, the company's shareholders decided to increase the authorized capital to UAH 2 million, and in March 2024, the authorized capital was increased to more than UAH 5 million.

Despite the fact that both shareholders paid their shares in full, a conflict between them arose as a result of changes made to the register of shareholders. In September 2024, at the general meeting of the company, the other co-founder was dismissed as a director and the victim was appointed in her place. However, on November 19, 2024, without his knowledge, the ex-director convened a new meeting, at which it was decided to exclude him from the company due to non-payment of his share in the authorized capital, although he had fully paid his share.

After that, based on the submitted documents, the state registrar of the Executive Committee of the Yuzhne City Council illegally changed the list of founders, reducing the company's authorized capital from UAH 5.1 million to UAH 2 million. All these actions led to the fact that on November 27, 2024, the withdrawal of working capital from the accounts of TOKA LLC began. In addition, the woman came to the office with several men and took away equipment and goods belonging to the company.

According to the evidence presented, the seized property includes agricultural machinery that is the subject of a criminal investigation. In particular, it is a mineral fertilizer spreader, a loading hopper, a sprayer, a sunflower harvester, a grain harvester, seeders, a plow, etc.

According to the victim, some of the equipment was purchased at his expense, and the rest was purchased at the expense of the company. The court granted the investigator's motion, and the property was seized.

The court also seized the property of a company accused of illegal granite mining in Mykolaiv region. The investigation focuses on the activities of Voznesenskaya Trade and Industrial Company officials who, after the license was revoked, continued to work at the Trykratnenske deposit.

Recently, a court in Mykolaiv imposed a pre-trial restraint on a defendant in the case of illegal groundwater extraction. She was part of a criminal group organized by a former deputy of the Mykolaiv City Council and was engaged in water extraction for further sale at the city's drinking water points.
