The High Council of Justice appealed to the Office of the Prosecutor General of Ukraine with a complaint against the behavior of lawyer Oleksandr Tsarenko in relation to judge Iryna Bratkiv of the Bilhorod-Dnistrovskyi Court, which the HCJ considers improper.
This was reported by the HCJ press service.
Also, the HCJ decided to appeal to the Office of the Prosecutor General to provide information on the disclosure and investigation of a criminal offense in criminal proceedings entered on July 9 in the Unified Register of Pre-trial Investigations under part one of Article 376 of the Criminal Code of Ukraine (Interference in the activities of judicial bodies).
In June, judge Iryna Bratkiv filed a complaint with the High Council of Justice against lawyer Oleksandr Tsarenko, who defended a man accused of premeditated murder in court and requested the court to oblige officials of the Prosecutor General's Office to provide him with temporary access to the full history of data viewing in the Unified Register of Pre-trial Investigations on criminal proceedings with the possibility of copying them. The judges refused him.
The lawyer again appealed to the court and stated in a second motion that the judge could be brought to disciplinary responsibility in disciplinary proceedings on the grounds of intentional or negligent unlawful denial of access to justice or other significant violation of procedural law in the administration of justice. At the same time, the lawyer noted that his remarks about the judge's responsibility should not be interpreted as pressure on justice. However, the judge still regarded these remarks as an attempt to put pressure on her.
In addition, the judge stated that the lawyer began posting on social media stating that a war had begun between him and the judge. He also allegedly threatened the person on whose complaint the criminal proceedings were initiated.
The judge also stated that the lawyer complained about her actions even when she was on a business trip and he had nothing to do with her proceedings.
