Judge Lyubov Nemchenko Temporarily Suspended for Ignoring Odesa Posting

Judge of the Economic Court of Kherson Region Lyubov Nemchenko, who did not report to her new workplace in Odesa after the Russian invasion, was temporarily suspended from administering justice.

This decision was made on April 23 by the Second Disciplinary Chamber of the High Council of Justice.

The chamber found the judge guilty of a disciplinary violation and decided to appeal to the High Council of Justice with a motion to dismiss her. According to the law, in such cases, the judge is automatically considered temporarily suspended until the High Council of Justice makes a final decision to dismiss or cancel the disciplinary sanction.

After the seizure of Kherson, Nemchenko was seconded to the Economic Court of Odesa Oblast in July 2022, but never reported to work in Odesa. In June 2023, she tendered her resignation, but stated that she had gone to the temporarily occupied territory of Kherson region in November 2022, allegedly to take care of her mother.

The Security Service of Ukraine drew attention to this fact, and the Department of National Statehood Protection complained to the HCJ. As a result, the Council suspended consideration of her resignation until the investigation was completed. In addition, Nemchenko ignored the HCJ's request for information about her situation.

Nemchenko's declaration for 2024 contains rather modest assets for a representative of the judiciary.

According to the document, the judge owns a 45-square-meter apartment in Kherson, which she purchased back in 2005. Nemchenko also declared a 2012 Volkswagen Polo car, which she has owned since August 2012.

The judge's only source of income in 2024 is her pension in the amount of UAH 247 thousand per year.

Liubov Nemchenko did not declare any securities, corporate rights, bank accounts, savings, unfinished construction projects or liabilities.

Earlier, Intent wrote that judge of the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast Natalia Anisimova refused to undergo a qualification test and lost her position. Prior to that, the High Council of Justice dismissed Yaroslava Balan, who worked at the Odesa District Administrative Court. The HCJ also accepted the resignation of another judge.
