The High Council of Justice has unanimously upheld the decision of the Disciplinary Chamber to dismiss Judge Oleksandr Boyarsky from the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast.

The decision was made following a complaint filed by DEJURE Foundation lawyers.

The Chamber identified 127 cases in which the judge determined the place of residence of children in favor of the father in violation of the law. The decisions were made without the participation of the guardianship authority, without proper investigation of the circumstances and in an abnormally short time. After that, the men could receive a deferral from mobilization and the right to travel abroad, allegedly because of independent childcare.

In August 2025, Oleksandr Boyarsky was found guilty of committing a criminal offense under Part 3 of Article 368 of the Criminal Code of Ukraine "Obtaining an undue advantage". He was sentenced to 6 years in prison, but released on probation for 3 years. For this period, he was banned from holding certain positions.

Oleksandr Boyarsky also undertook to transfer UAH 1 million 59.8 thousand, which was paid as bail for him, to the needs of the Ukrainian Defense Forces. In addition, the court confiscated 20 thousand dollars and 200 thousand hryvnias, which were in the bank accounts of the accused.

Judge Oleksandr Boyarsky of the Bilhorod-Dnistrovskyi City District Court was at the center of a corruption scandal in 2023, when he was suspected of taking a bribe to help a man evade mobilization.

On January 12, the High Council of Justice granted permission to keep the judge in custody. On January 16, 2024, the High Anti-Corruption Court arrested the judge for two months with the possibility of bail in excess of UAH 1 million.

According to the investigation, in December 2023, Boyarsky took $1,500 for making a decision that would allow the father to officially formalize the child's residence with him. Such a document makes it possible to avoid mobilization and go abroad with the child.
