In Kherson region, the AMCU fines two entrepreneurs for collusion in bidding

The Administrative Board of the Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine established the existence of collusion between individual entrepreneur A.P. Kabak and individual entrepreneur I.M. Nesterenko during their preparation and participation in the procurement procedure for hardwood firewood, which was conducted in 2018 by the Housing and Maintenance Department of Kherson of the Ministry of Defense of Ukraine. The expected cost of the procurement procedure was UAH 4 million 200 thousand.

The report says that, based on the results of the case, the Department established the facts of joint use of the same telecommunications equipment, similarity in documents, procurement of goods from the same suppliers and other circumstances that indicate the coherence of the defendants' behavior. Based on the findings, the administrative board of the Southern MTV recognized the actions of individual entrepreneur A.P. Kabak and individual entrepreneur I.M. Nesterenko as a violation of the legislation on protection of economic competition under Article 50(1), paragraph 4 of Article 6(2) of the Law of Ukraine "On Protection of Economic Competition" in the form of anticompetitive concerted actions related to distortion of bidding results.

The AMCU imposed fines of UAH 68,000 each on both individual entrepreneurs.

Earlier it was reported that an entrepreneur from Kherson region was accused of abusing his monopoly position in the market. The violation was discovered in the course of state control over compliance with legislation on the protection of economic competition in the field of delivery and storage of temporarily detained vehicles. The violation is that from the beginning of May 2023 to June 2024, the entrepreneur set and applied prices for transportation (delivery) of vehicles temporarily detained by the National Police in Kherson region to special sites (parking lots) in the city of Kherson and Kherson region, which include additional costs that are not provided for by the relevant orders of the Cabinet of Ministers of Ukraine, without economic justification.
