3 Odesa Developers Pay 2 ₴ Million in Infrastructure Fees After

Three developers have reimbursed more than UAH 2 million to the local budget for their share participation in the development of Odesa's engineering, transport and social infrastructure.

This was reported by the press service of the Odesa Regional Prosecutor's Office.

It has been established that during 2020-2023, active construction of commercial facilities, such as cafes, supermarkets, and other buildings, was carried out in Odesa. At the same time, not all developers fulfilled their statutory obligation to pay a share in the development of the city's infrastructure.

In order to protect the interests of the community, the prosecutor's office filed a lawsuit with the Commercial Court of Odesa Oblast. During the court proceedings, the business entities voluntarily reimbursed the losses incurred by the budget.

Investors' equity participation in the creation of social, engineering and transport infrastructure of the city is a one-time contribution that the investor must pay to the city budget, excluding the value added tax applicable on the date of payment.

In 2023, another developer owed the Odesa city budget UAH 2 million in payments for equity participation in the creation of the city's social, engineering, and transport infrastructure. At that time, the money was sued from them in the Malynovskyi court.

Also in the same year, the Southwestern Commercial Court of Appeal upheld the decision of the first instance court regarding a 0.38-hectare land plot worth UAH 24.5 million in Odesa.

This is the plot at 35 Pestel Street, which was appealed to the Southwestern Commercial Court of Appeal in February 2023 by the additional liability company Production Construction and Assembly Association Odessbud.

According to real estate websites, the construction of the Parkovyi 2 residential complex was planned here.

Thecourt invalidated the decision of the city council and the lease agreement and ordered the company to return the land plot to the territorial community of Odesa.

The court then agreed with the prosecutor's arguments and declared the city council's decision illegal and the lease agreement invalid, and ordered the company to return the land plot to the territorial community of Odesa.
