A resident of the Odesa region won a 5-million lawsuit against the head of the village council over an unbuilt road

A court orderedTimur Khasaev, the head of the Tairovska Territorial Community, and three other officials to pay a local resident 5 million hryvnias in compensation for a road that the village council was supposed to build but has not yet completed.

The Ovidopol District Court of Odesa Oblast issued the ruling.

Since 2019, Zhanna Pozhidaeva and other residents of the street have repeatedly appealed to the settlement head, Timur Khasaev, and the council secretary, Alexander Orlov, requesting that they construct a road for vehicle traffic in the direction of Stara LyustdorRoad.

In April 2023, the Odesa District Administrative Court partially granted Pozhidaeva’s claim: it ruled that the inaction of the Tairovka Village Council was unlawful and ordered it to pave Pyvovarna Street. The decision took legal effect on May 4, 2023.

Despite this, the settlement council has still not built the road over the years. Pozhidaeva had to file another lawsuit—requesting the court to establish judicial oversight of the decision’s enforcement.

As part of this oversight, the court issued nine rulings finding the town council’s reports unsatisfactory and imposed fines on the council chair three times for failure to comply with the court’s decision.

In addition, two criminal cases were opened due to this inaction.

Zhanna Pozhidaeva filed another lawsuit—this time seeking 5 million hryvnias in compensation for emotional distress from the council officials. She noted that years of litigation, appeals to law enforcement agencies, and expenses for legal assistance had negatively affected her health and psychological well-being.

As a result, the Ovidiopol District Court of Odesa Oblast ruled that the inaction ofTimur Khasaev, head of the Tairovska Territorial Community; Council Secretary Oleksandr Orlov, Head of the Housing and Utilities and Infrastructure Department Yuriy Paraskevych, and Head of the Urban Planning, Architecture, and Land Management Department Nadiya Stafeyeva.

The court ordered them to jointly pay the plaintiff 5 million hryvnias in compensation for moral damages. At the same time, the decision was rendered in absentia and may be reviewed or appealed in accordance with the procedure established by law.
