A border guard from Izmail was sent to a disciplinary battalion for hitting a pedestrian

In Izmail, a border guard struck a woman on a crosswalk while driving a government vehicle. The court handed down a sentence.

This was reported by the Center for Public Investigations, citing the verdict of the Izmail City and District Court of Odesa Oblast.

The accident occurred on September 8, 2023, in Izmail.

According to the case file, a border guard sergeant driving a Renault Duster service vehicle failed to slow down as he approached an unregulated crosswalk on Mir Avenue and struck a woman who was crossing the street at the crosswalk. 

As a result of the accident, the victim sustained moderate injuries—a closed head injury, a contusion, multiple abrasions, and closed fractures of the pelvic bones.

The defendant admitted only partial guilt. He explained that the sun had blinded him that day, so he did not see the pedestrian. He admits partial guilt because he believes the victim herself should have made sure no vehicles were approaching before crossing the street.

The victim stated that before stepping onto the crosswalk, she looked both ways, noticed a car about 50 meters away, and had almost reached the middle of the road when she was struck. According to her, the driver did not compensate her for the damages or apologize.

A witness who was in the car with the defendant at the time of the accident confirmed the circumstances of the collision. The victim’s daughter stated that the defendant approached her at the scene of the accident and offered her money, but she refused.

The court reviewed the statements of the parties to the proceedings, the expert reports, the accident scene inspection report, and the surveillance camera footage capturing the traffic accident itself.

During the trial, the court reviewed witness testimony, surveillance camera footage, and expert reports, and concluded that the vehicle was in good working order and that the accident was caused by the driver’s violation of traffic rules.

His actions were classified under Part 1 of Article 415 of the Criminal Code of Ukraine—violation of the rules for driving a military vehicle, resulting in moderate bodily injury to the victim.

 Thecourt found the State BorderGuard Service member guilty and sentenced him to nine months’ confinement in a disciplinary battalion.

In addition, he was ordered to pay court costs for expert examinations in the amount of 21,961 UAH and the victim’s legal fees in the amount of 14,800 UAH.
