The Court of Appeals overturned the ruling to transfer to Kyiv the case involving a lawsuit filed by Ukratlantik LLC against the Russian Federation for 2.4 million hryvnias. The Odesa Regional Commercial Court will continue hearing the case on its merits.
This is stated in the ruling of the Southwestern Commercial Court of Appeals.
Going forward, the court must determine the validity of the company’s claims and issue a ruling on the recovery of funds from the Russian Federation.
The company is seeking compensation for property damaged during a missile and drone strike on the Odesa region in September 2023. At that time, equipment and toll-processed raw materials (materials that did not belong to the company itself but to its customers and had been transferred to it for processing) were destroyed.

Initially, the local court decided to transfer the case to the capital, reasoning that the Russian Federation has no official presence in Ukraine, and its property—the building of the former embassy—is located in Kyiv. However, the appellate court agreed with the plaintiff’s arguments. The court recognized that the law permits filing a lawsuit in the location where the property damage occurred. In this case, that is the Odesa region.
Ukratlantik LLC is a factory founded in 2007 in the Odesa region (the village of Usatove). It is a subsidiary of the French conglomerate Groupe Atlantic. The plant specializes in the full-cycle production of household electrical appliances, including storage water heaters (boilers) and electric convector heaters under the well-known Atlantic brand.
