The Novokakhovka Electromechanical Plant won a court ruling against the Russian Federation for more than 315,000 U.S. dollars in compensation for lost profits due to the occupation of the plant. At the same time, the court denied the claim for 16.8 million hryvnias in compensation for lost property, dismissed the case against Vladimir Putin, and rejected the request to freeze Russian assets in Spain.

This is stated in the decision of the Commercial Court of the Odesa Region.

During the proceedings, the court confirmed that Russia, as an aggressor state, is deprived of judicial immunity in cases involving compensation for damages. The court recognized the plant’s lost profits as proven, based on the expert opinion provided. At the same time, the claim regarding the loss of property was denied due to the lack of a proper assessment of the damages.

The court also dismissed the proceedings against the named co-defendants—Vladimir Putin, as well as Russian businessmen and cultural figures—since individuals cannot be defendants in this category of commercial disputes. The request to seize Russian property in Spain was also rejected, as the identification of foreign assets for confiscation falls within the jurisdiction of enforcement authorities, not the court.

The case file noted that the plant’s production facilities have been under temporary occupation in Nova Kakhovka since February 24, 2022. Due to the armed aggression, the enterprise has completely lost the ability to conduct business operations, generate profits, and evacuate its property.
