Kherson Prosecutors Safeguard Oleksandrivskyi Nature Reserve Lands

In the Kherson region, the prosecutor's office protected the land of theOleksandrivskyi Nature Reserve Fund from illegal use.

According to the Kherson Region Prosecutor's Office, the intervention of the Oleshky District Prosecutor's Office helped preserve the lands of the nature reserve fund in the Kherson district. The case concerned a disputed land plot of more than 13 hectares worth more than UAH 100 million.

"The Economic Court of Odesa Region upheld the prosecutor's claim and canceled the illegal decision of one of the village councils, which unreasonably recognized part of the land of the Oleksandrivskyi landscape reserve of national importance as an agricultural plot," the statement said.

"The Oleksandrivskyi Nature Reserve is a 996-hectare area with a unique natural complex that has important scientific, aesthetic, and environmental value. It was created by a Presidential Decree to preserve the steep slopes of the Dnipro Estuary, rare steppe landscapes and the diversity of flora and fauna listed in the Red Book of Ukraine and typical plants and animals.

The prosecutor's office demanded that the order of the Main Department of the StateGeoCadastre in Kherson Oblast be declared illegal and canceled, that the ownership and state registration of the land plot as agricultural land be terminated, and that it be returned to the land manager.

Prosecutors proved in court that the village council's decision contradicted the norms of land and environmental legislation. The court fully upheld the prosecutor's position and canceled the illegal decision, and returned the possibility of proper management and protection of the territory to the state.

Earlier, with the intervention of the prosecutor's office, the Kherson community was returned to the use of 80 hectares of land worth almost UAH 2 million. One of the companies leased the land for production activities related to landscaping in Kherson and the region. However, contrary to the current legislation and the terms of the agreement, the lessee did not pay the rent during 2022-2024, owing money to the local budget.

Kherson prosecutors also defended in court the state's right to forest land plots with a total area of more than 42 hectares. And the Oleshky District Prosecutor's Office ordered the local government to organize the work on the in-kind delineation of the natural reserve fund object - theSofiyivsky Botanical Reserve of local importance.
