The Mykolaiv City District Prosecutor's Office is demanding that the city council's decision to lease a 7,643-square-meter plot of land for the construction of a gas station be revoked.

This was reported by the Mykolaiv Regional Prosecutor’s Office.

According to the case file, the prosecutor’s office filed a lawsuit with the Commercial Court seeking to invalidate the land lease agreement. They are demanding that the land be returned to the community in a usable condition, which would require the demolition of the unfinished building.

The disputed plot is a recreational green space for public use. It is located at the intersection of Bogoyavlensky Avenue and Shura Kober Street. It was first leased for the construction of a sports and health center in 2005. By 2015, the lessee had not built anything there. Given the lessee’s failure to comply with the terms of the lease agreement, as well as public outrage over the removal of greenery, the city council refused to renew the lease. The tenant was ordered to return the land and demolish the unfinished structure (5% complete). In 2023, courts of two instances upheld the legality of this decision.

In 2024, the Mykolaiv City Council once again leased the same land to the same company for the same purposes. At the meeting, council members unanimously voted to change the designated use of the plot. It was now designated for the construction of a gas station. This was done despite warnings from the city council’s legal department regarding the lack of legal grounds for such a transfer and a violation of the competitive bidding procedure for acquiring land lease rights.

The Mykolaiv Regional Prosecutor’s Office also reported on the trial of officials from a municipal enterprise of the Mykolaiv City Council, who are accused of embezzling 1.3 million hryvnias in the procurement of traffic lights. According to investigators, the director and the lead lawyer were aware that the traffic light equipment had not actually been delivered under the procurement contracts. Despite this, they ensured that the budget funds were transferred to the supplier in full.
