Mykolaiv construction firm fined for falsifying tender results

In Mykolaiv, a company was fined for misrepresenting the results of a tender held on Prozorro. In addition to falsifying the auction results, the company is accused of failing to provide information and obstructing the investigation of antitrust authorities.

This was reported by the press service of the Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine.

Thus, Construction Firm Mykolaivavtodor PE was accused of violating competition law by refusing to provide information at the request of the head of the department.

The company is suspected of violating the legislation on protection of economic competition by falsifying the results of bidding on Prozorro. The department sent a request for information, but the company did not provide the required information and did not request an extension of the deadline.

This caused complications in the Department's performance of its functions under part one of Article 7 of the Law of Ukraine "On the Antimonopoly Committee of Ukraine", especially in the investigation of the case related to the falsification of auction results.

Pursuant to Article 50(13) of the Law of Ukraine "On Protection of Economic Competition", failure to submit information within the stipulated period is considered a violation of competition law. Thus, the company was fined.

The antimonopoly authorities also found collusion between Blagoustriy-NK and individual entrepreneur A.M. Yakovenko during the tender. The matter concerns the repair of a green zone on a street in Zavodskyi district of Mykolaiv in 2019. The cost of the work was estimated at almost UAH 5.8 million. The investigation showed that these participants acted in concert to distort the results of the tender.

In July, two companies from Khmelnytskyi region colluded in an auction for the purchase of diesel generators for Mykolaiv region. The collusion between the two companies was established during two procurement procedures conducted in early 2023 by the utilities of Mykolaiv and Khmelnytskyi. The value of the procurement was over fifteen million hryvnias.

In addition, the Antimonopoly Committee challenged the Mykolaiv Regional State Administration's tenders for the reconstruction of the water supply system. Three procedures worth UAH 209 million were blocked due to a complaint from a cheaper bidder who was rejected by the customer.
