Court in Mykolaiv canceled the fine of TCC due to Reserve+

The Korabelnyi District Court of Mykolaiv has overturned the decision of the Military Commissariat to impose a fine of UAH 17 thousand on a person liable for military service who was accused of failing to update his military registration data.

This became known to Intent from the decision in which the court found that the man had updated the information on time through the Reserve+ application.

This is a case in which the head of one of the TCCs fined a man in April 2025 under Part 3 of Article 210 of the Code of Administrative Offenses. The decision stated that the person liable for military service allegedly failed to personally notify the territorial recruitment center of the change in personal data during a special period. The fine amounted to 17 thousand hryvnias.

However, the plaintiff went to court and stated that he had updated his data through the Reserve+ application before the statutory deadline. He also emphasized that the administrative case was considered without his participation and without proper notification of the date of the hearing.

During the hearing, the court found that the man had indeed updated his credentials within the prescribed period - by July 16, 2024 - through the electronic service"Reserve+". At the same time, the TCC representatives did not take this information into account when making the decision and did not provide evidence that the necessary data could not be obtained through the electronic interaction of registers.

In addition, the court drew attention to a violation of the case consideration procedure. The minutes indicated one date of the meeting, but in fact the decision was made on another day without notifying the plaintiff. As a result, the man was deprived of the opportunity to defend his rights and provide explanations.

As a result, the court upheld the administrative claim, canceled the fine decision and closed the case on the administrative offense. The decision can still be appealed to the Court of Appeal.

Recently, in Mykolaiv, the court extended the detention of a man suspected of running a Telegram community where the workplaces of representatives of the TCC and mobilization groups were published. According to the investigation, the channel had more than 34 thousand members.
