Court collects 2 million debt from land tenant in Odesa

The Commercial Court upheld the claim of the Khadzhybey District Prosecutor's Office of Odesa and terminated the land lease agreement concluded by the city with a limited liability company.

This was reported by the press service of the Odesa Regional Prosecutor's Office.

Also, the city budget is to recover more than UAH 2 million in debt for its use. Prosecutors found that in 2011, the Odesa City Council leased a land plot of almost 0.2 hectares to the company for the design, construction, and further operation of a gas station and car wash. The regulatory monetary value of the land is UAH 5 million.

However, for 14 years, the tenant has not started its development and has not built a road service facility. In addition, since September 2022, the company has stopped paying the rent stipulated in the agreement. Therefore, in order to protect the interests of the local community, the prosecutor's office filed a lawsuit with the commercial court.

Earlier, the Khadzhybeyskyi District Prosecutor's Office of Odesa filed a lawsuit against the developer, who, according to the prosecutor's office, owed the city UAH 440 thousand. After the proceedings were initiated, the defendant voluntarily paid UAH 253 thousand of the principal debt and UAH 188 thousand of the fine.

The court also satisfied the prosecutor's claims and ordered to recover UAH 1 million 844 thousand from another company to the budget of Odesa. The prosecutor 's office found that in 2020-2021, the developer built an apartment building on Pedagogichna Street in Odesa with an underground parking lot with a total area of more than 4,000 square meters.

In October 2025, a construction company that built a six-story building with 40 apartments in Sechenov Lane was forced to pay UAH 600,000 to the city budget. Prior to that, the court upheld a lawsuit filed by the Khadzhybey District Prosecutor's Office of Odesa and forced the developer to pay more than UAH 2 million in debts to the budget. According to prosecutors, in 2018-2021, the developer built the first phase of an apartment complex with underground parking lots, built-in public premises and a service station with a convenience store and administrative and household premises on Fontanska Road.
