Odesa developer forced to pay 2 million debt on equity participation

The court upheld the claim of the Khadzhybey District Prosecutor's Office of Odesa and forced the developer to pay more than UAH 2 million in debts to the budget.

This was reported by the press service of the Odesa Regional Prosecutor's Office.

According to prosecutors, in 2018-2021, the developer built the first phase of an apartment complex with underground parking lots, built-in public premises and a service station with a convenience store and administrative and household premises on Fontanska Road.

At the same time, the customer violated urban planning and budget legislation by failing to pay the mandatory share participation in the development of urban infrastructure. The prosecutor's office filed a lawsuit with the commercial court to recover the debt.

According to the court's decision, the Odesa budget received UAH 1.2 million in arrears in payment of the share participation, as well as penalties in the amount of over UAH 900 thousand.

Earlier, the Supreme Court of Ukraine sided with the Odesa Regional Prosecutor's Office in a dispute with a developer building a residential complex in the village of Limanka in the Tairova community. The Chornomorsk District Prosecutor 's Office found that from 2019 to 2024, i.e. for more than 5 years, the developer in Limanka was building facilities, but did not pay a single penny to the budget of the Tairovska community.

Meanwhile, in September, an Odesa court considered a case of illegal construction on the former Lidersivskyi Boulevard (now Hetman Sahaidachnyi Boulevard). The case involved a multi-year scheme involving city council officials, officials of the State Geocadastre, and private companies that destroyed tennis courts and began construction of a residential complex without proper permits. The court considered in a closed session a request to inspect the land plots as part of a criminal case on abuse of power, forgery, fraud, illegal construction and forgery of documents.
