Court closes case on fraudulent school renovation in Yuzhnoukrainsk

In Mykolaiv, a court considered a complaint filed by an NGO against police inaction in a case of alleged embezzlement of budget funds. It was about more than 7 million hryvnias that could have been misappropriated during the construction of a shelter for a lyceum in Pivdenoukrainsk.

This is evidenced by the decision of the Central District Court of Mykolaiv.

The judge considered a complaint filed by the chairman of the board of the NGO "Platform Civic Control" against the action of police investigators who, according to the applicant, failed to register a criminal offense in the Unified Register of Pre-trial Investigations.

It was a complaint about possible abuse of power by officials of the Mykolaiv Regional State Administration's Urban Development Department and representatives of a private construction company. According to the applicant, they could have organized a scheme to misappropriate more than 7.2 million budget funds during the construction of a shelter for lyceum No. 4 in Pivdenoukrainsk by overstating the cost of materials and work.

The applicant insisted that law enforcement officers had failed to comply with the requirements of the law and had not opened criminal proceedings following his appeal. In this regard, he asked the court to oblige the police to enter the relevant information into the URPTI.

However, the court found that this application had in fact been processed: it was attached to an existing criminal proceeding opened earlier on similar facts. The pre-trial investigation in this case is ongoing, and the law does not provide for repeated entry of identical information into the register.

Taking these circumstances into account, the court concluded that there were no grounds to satisfy the complaint and dismissed the complainant.

Also in April, in Mykolaiv region, a judge refused to arrest an engineer for failing to repair heating networks. According to the case, the engineer not only approved the changes, but also failed to take into account possible technical risks, including the threat of gusts and damage to the network due to the materials not being suitable for the operating conditions.
