The court ruled that Mykolaivoblenergo owns the substation

The court recognized JSC "Mykolaivoblenergo" as the owner of the transformer substation building by virtue of acquisitive prescription. The utility company had continuously and openly maintained the facility on Ozerna Street for over 35 years, but did not have official title documents for it.

This is stated in the decision of the Commercial Court of Mykolaiv Oblast.

The court established that the company has owned and operated the substation since 1989, when it was transferred to its balance sheet from the Black Sea Shipbuilding Plant. All these years, “Mykolaivoblenergo” has maintained the facility at its own expense, carried out regular repairs, kept technical records, and ensured the distribution of electricity to consumers. In addition, since 2014, the company has officially leased the land plot under this facility from the city council.

Despite its long-term use, the company did not have an official legal title (a purchase agreement or a certificate of ownership) to the building itself. No government agency had taken the facility onto its balance sheet, and it was not recorded as state or municipal property.

The Mykolaiv City Council served as the defendant in the case. It did not raise any objections to the claim, confirming that the substation is not municipal property and that the city council does not have specialized enterprises to maintain it.

The court concluded that the substation had not been removed from civil circulation and, therefore, could be subject to acquisitive prescription.
