The AMCU suspects Mykolayivkomuntrans of abuse

The Antimonopoly Committee has opened a case against Mykolaivkomuntrans utility company. The utility company is suspected of establishing a monopoly and violating competition in the waste sector.

This was reported by the Southern Interregional Department of the Antimonopoly Committee of Ukraine.

According to preliminary data from antitrust authorities, the utility company has held a dominant position in the market of solid waste collection and disposal services in Mykolaiv region for several years.

The investigation revealed that the company had abused its position by preventing other companies from entering into contracts and setting different conditions for equivalent agreements without objective reasons.

It was found that Mykolaivkomuntrans monopolized the market in a 35 km radius around the city landfill, which led to a lack of competition. The company was also accused of delaying the signing of contracts with other companies, in particular with Nik-Spetsservice, which deprived them of the opportunity to participate in public procurement for garbage collection in Mykolaiv.

The AMCU ordered Mykolaivkomuntrans to cease these actions and scheduled the case for consideration on October 28, 2024. The company will be given the opportunity to present its explanations or objections. If its guilt is proven, the utility company faces a fine for violating antitrust laws.

Antitrust authorities are also investigating violations of competition in fire safety tenders. In particular, Spetspozhservice-Yug and Spetsavtomatika-2007 are suspected of concerted actions when participating in tenders in 2023.

These are three large procurements: installation of fire alarms in educational institutions of the Bratske village council of Voznesensk district, Mykolaiv region, overhaul of the fire system in the Yelanets village council, and works at Odesa Polytechnic University.

In addition, the AMCU found signs of collusion in the bidding for road repairs in Voznesensk.

And recently, a company in Mykolaiv was fined for distorting the results of a tender held on Prozorro. In addition to falsifying the auction results, the company is accused of failing to provide information and obstructing the investigation of antitrust authorities.
