Entrepreneur from Kherson region accused of abuse of monopoly position in the market

On September 25, 2024, the administrative board of the Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine started consideration of the case on violation of the legislation on protection of economic competition by individual entrepreneur M. Berezhansky.
This was reported by the press service of the agency.
The report says that the violation was established in the course of state control over compliance with the legislation on the protection of economic competition in the field of delivery and storage of temporarily detained vehicles. The violation is that from the beginning of May 2023 to June 2024, the entrepreneur set and applies prices for transportation (delivery) of vehicles temporarily detained by the National Police in Kherson region to special sites (parking lots) in the city of Kherson and Kherson region, which include additional costs that are not provided for by the relevant orders of the Cabinet of Ministers, without economic justification.
The AMCU noted that such actions of the entrepreneur contain signs of a violation under paragraph 1 of part two of Article 13, paragraph 2 of Article 50 of the Law of Ukraine "On Protection of Economic Competition" in the form of abuse of monopoly (dominant) position in the services market.
Earlier it was reported that the administrative board of the Southern Interregional Territorial Department of the AMCU established the existence of collusion between individual entrepreneur A.V. Ulida and individual entrepreneur Y.M. Demydenko during their preparation and participation in the open tender for the purchase of "boats". The bidding was conducted by the Children's and Youth Sports School "Spartak" of the Kherson City Council and the municipal institution "Kherson School of Higher Sportsmanship" in 2017.
