A court in Odesa denied the prosecutor’s office’s request to freeze the funds and assets of a private company in a case involving the recovery of more than 15 million hryvnias in equity contributions. The court found no grounds for such a decision.
This is stated in the ruling of the Southwestern Commercial Court of Appeals.
The appellate court agreed with the findings of the Odessa Regional Commercial Court and confirmed that the mere size of the claims is not grounds for freezing the assets of an operating business. The panel of judges noted that the prosecutor’s office had not provided any evidence that “MODA” LLC was attempting to conceal assets, transfer funds, or evade payment of the debt.
Law enforcement officials filed the lawsuit on behalf of the Odesa City Council. They are demanding that the developer pay 14.2 million hryvnias in unjustly retained funds from the city’s infrastructure development contribution for the completed residential complex. The case concerns a 16-story building with offices and underground parking at 17-A Akademika Glushka Avenue. Authorities are also seeking to recover accrued interest and inflation-related losses from the developer.
To ensure compliance with a future ruling, the prosecutor’s office requested that the company’s accounts and assets be frozen. However, the trial court denied the request for a freeze, after which the prosecutors filed an appeal.
