In Mykolaiv region, a village council registered land plots near the Black Sea in its name, contrary to a court decision. The cost of the plots is over eight million hryvnias.
This was reported by the press service of the Mykolaiv Regional Prosecutor's Office.
The Mykolaiv District Prosecutor's Office filed a lawsuit with the Commercial Court to return the forest land to the state. The 0.99-hectare plot is located in the Rybakivka recreation area. Its value is over UAH 8 million.
Back in 2014, the court had already upheld the prosecutor's claim and annulled the illegal decision of the Berezan District State Administration, which leased the land to a private company and later sold it as its property.
The court then confirmed that the land of the state forest fund located within the Black Sea coastal protection zone cannot be transferred to private ownership. This decision was enforced, and the state's rights to these lands were restored.
However, in 2021, the Koblivka Village Council, in violation of the law, illegally withdrew this land from the fund and registered it as its property. In order to restore the state's interests, the Mykolaiv District Prosecutor's Office filed a lawsuit demanding that the registration of communal ownership be canceled and the land returned to the state.
The court has now opened proceedings and is considering the case.
Such cases are not uncommon in Mykolaiv region. For example, recently, in Pervomaiskyi district, forest land with a lake was illegally transferred to private ownership. The court canceled the right of private ownership of this land plot. It is a land plot with a total area of 12 hectares and a value of UAH 54 million.
The prosecutor's office also responded to violations in the disposal of water fund lands worth UAH 3.8 million. A lawsuit was filed in court to invalidate certificates of ownership of real estate and to oblige the return of five land plots with a total area of 5,000 square meters.
And the StateGeoCadastre transferred a 27.5-hectare plot of forest land worth almost UAH 170 million to the Snihuriv City Council. This plot is located close to the Ingulets River and partially overlaps with the Kishynka Creek and the protective coastal strip, where agricultural activities are prohibited.
