Bureau of Economic Security rejects results of tender for repair of village council in Odesa region

Analysts of the Territorial Department of the Bureau of Economic Security in Odesa Oblast have identified a risky tender for the reconstruction of a building of one of the village councils in Odesa District.
According to the BES, the expected cost of the procurement was UAH 29.2 million.
In the course of information and analytical activities, the Bureau's specialists found that, according to the financial statements for the last 5 years, the average annual income of the company participating in the procurement was only UAH 2.2 million, while the required amount was UAH 8.8 million.
Thus, the tenderer's proposal does not meet the requirements set forth in the tender documentation. The analysts sent a letter of recommendation to the village council and recommended conducting a compliance audit during the tender.
"As a result, the village council canceled the risky procurement of building reconstruction services. This helped prevent the inefficient use of UAH 29.2 million of budget funds," the BES emphasized.
It should be noted that on December 18, a procurement for the reconstruction of the administrative building of the Dalnytsia village council was planned. The expected cost of this procurement was UAH 29 million 180.4 thousand.
In October, the village council had already tried to find a contractor. A full-fledged auction was held with the participation of four limited liability companies: "ETM Group, Stroyspetsstechnika, Grado-Stroy Insurance Company, and Stroy-Bud-Kran.
The winner was ETM Group LLC, which agreed to work for UAH 24 million 360.4 thousand. However, state auditors found violations of public procurement legislation in the procurement process, which proved impossible to eliminate.
Open bidding with special features means that almost all terms are shorter than in open bidding under the Law on Public Procurement. This means that this procurement is much faster than open tenders.
The period for submitting proposals is seven calendar days, and the period for challenging qualifications is five calendar days. Often, there is no auction during such tenders, so the participant has no competitors.
However, after the start of the full-scale invasion, the Cabinet of Ministers of Ukraine temporarily changed the rules of bidding for the period of martial law in Ukraine and within 90 days from the date of its termination or cancellation. Thus, the government temporarily canceled electronic auctions. Since then, tenders announced in Prozorro can be held without an auction.
