The State Geocadastre illegally removed 12.8 hectares of forest from state ownership

The Beryslav District Prosecutor’s Office has filed three lawsuits seeking the return to state ownership of forest land plots with a total area of 12.8 hectares, which, according to the investigation, were illegally transferred to municipal ownership.

This was reported by the Kherson Regional Prosecutor’s Office.

The land plots in question are located near the village of Tyaginka in the Beryslav District of the Kherson Region.

According to the prosecutor’s office, in 2020, based on an order from the Main Directorate of the State Geocadastre in the Kherson region, these lands were removed from state ownership and registered as municipal property. At the same time, their designated use was changed from forest land to agricultural land.

Prosecutors determined that, during the formation of the plots, lands belonging to the forest fund—which were under permanent use by the state forestry and hunting enterprise—were unjustifiably included in their composition. In accordance with the requirements of the law, these lands were supposed to remain in state ownership.

In light of this, the prosecutor’s office filed a lawsuit demanding that the state registrar’s decision and the registration of communal property rights be revoked, that obstacles to the exercise of state property rights be removed, and that the disputed land plots be returned to their rightful user.

Previously, the Prosecutor’s Office had successfully sought through the courts the return to thestate of an 18.86-hectare plot of land designated forforestry purposes, located in the Darivska community of the Kherson district.

In addition, the court returned to state ownership nearly 97 hectares of landwithin the “Kam’yanska Sich” National Nature Park, which had previously been transferred to communal ownership as agricultural land.
