Kherson State University has returned the premises of the training center to use. The prosecutor’s office proved that the university’s boathouse had been used illegally for the private storage of kayaks.

This is stated in a ruling by the Commercial Court of Odesa Oblast.

During the court proceedings, the business owner acknowledged the claims and returned the premises to the university ahead of schedule pursuant to a transfer and acceptance certificate. In light of this, the court dismissed the case regarding the claim for the return of the property; however, it officially declared the lease agreement invalid and allocated court costs among the defendants.

The case involved 50 square meters in a boathouse building, which the Regional Branch of the State Property Fund and the university leased to the entrepreneur in December 2020. The property was leased through an electronic auction and with the approval of the Ministry of Education.

Law enforcement officials later determined that the educational institution’s property was being used for purposes unrelated to the educational process, which violates the Law of Ukraine “On Education.” The lease agreement did not specify that the storage of kayaks was intended specifically for students or educational purposes, which created an opportunity to use state-owned space exclusively for private commercial purposes.

The boathouse of the water sports center is part of the material and technical infrastructure of Kherson State University. It was built in the second half of the 20th century. The water sports and recreation complex, complete with the necessary infrastructure, was built as a specialized facility for educational and training activities as well as student recreation.
