Residents of a house in Odesa report raider seizure

A conflict that has signs of a criminal offense has broken out in an apartment building in Odesa. It is about possible falsification of documents, change of management of the condominium and further actions that led to financial losses and lack of heating in the buildings.

The confrontation between the co-owners has been going on for years and eventually became criminal. Back in 2012, the residents created the Svoboda-43 condominium and took over the management of the building, which was previously serviced by the UYUT-43 housing cooperative. At the same time, according to the residents, the cooperative, without having any legal grounds to do so, actually continued to influence the management.

In December 2022, the co-owners confirmed their independent management and elected a new board headed by the applicant. However, in April 2025, an initiative group emerged and announced a new meeting and a change in the management of the condominium - this was the turning point in the conflict.

The applicant claims that the minutes of the meeting of April 30, 2025, may be forged: some of the signatures were allegedly put on behalf of people who were abroad at the time. Criminal proceedings were opened over this fact, which further escalated the situation.

After the change of management, the situation deteriorated sharply. According to the residents, the new management dismantled the heating system - the gas boilers were removed and taken away in an unknown direction, leaving the building without heat before winter. In addition, according to the co-owners, dubious financial transactions took place: debts were written off for some residents, condominium funds were used to cover the obligations of a third-party cooperative and lawsuits were initiated over alleged debts.

The applicant believes that these actions may indicate an attempted raider seizure of the building in order to return it to the control of the UYUT-43 housing cooperative. She recalled that back in 2023, the commercial court ordered the cooperative to transfer the building to the condominium, but this decision has not yet been enforced. According to her, the new board is not counteracting the situation, but acting in the interests of the cooperative.

Several criminal proceedings have been opened as part of the case, including one on possible forgery of documents and financial abuse. The applicant asked the investigator to provide access to the materials, citing her status as a victim, but was denied.

The complaint against the investigator's actions was considered by the court. The judge found that the applicant did not have the procedural status of a victim, and therefore could not familiarize herself with the case file. The decision stated that she was currently acting only as a complainant and had not provided adequate evidence of harm, so the investigator's actions were recognized as lawful.

As a result, the court dismissed the complaint, and the conflict over the house remains open.
