Odesa models OnlyFans win eight cases in court against tax authorities

OnlyFans content authors in Ukraine managed to appeal and partially or completely cancel fines from the State Tax Service, with every third case won being a complaint in Odesa region.

According to analysts of the Opendatabot platform, there are eight such cases won in Odesa region out of 27 won in Ukraine in general.

For example, in Odesa region, the reason for the cancellation of a fine of more than half a million was a banal mistake with the address: the tax office failed to properly notify the person of the audit, which the court recognized as illegal.

Following Odesa region is Dnipropetrovs'k region with 5 cases. However, in some regions, in particular, in Zhytomyr and Rivne regions, despite the opened proceedings, there are no cases won yet.

27 cases is almost a third of the 94 cases where models tried to defend their rights. This year, the courts have already made 13 decisions in favor of content authors. February was a record month with 5 decisions.

In 92% of cases, the courts sided with the plaintiffs due to violations of procedures by the State Tax Service. Most often, the Tax Service sent documents to old addresses. The letters were returned, but the audits were still carried out. As a result, the courts recognized such audits as illegal, and all the charges along with them.

At the same time, the Tax Service often relied on letters from the British tax authorities regarding payments from Fenix International Ltd, which operates OnlyFans. However, the courts have consistently emphasized that such letters are only a pretext for an audit, not proof of income. Without bank statements, contracts, or other primary documents, the additional charges are recognized as unjustified.

Odesa region is also among the regions with the largest number of debts in Ukraine, with more than 585,000 proceedings in the register. In general, the number of records in the country has exceeded 9.5 million and continues to grow.
