The second consecutive attempt to sell the receivables of the “SY Zhnyva” Farm in Odesa to Russian entities for more than 3.8 billion hryvnias ended unsuccessfully.
The repeat hybrid Dutch auction, which was scheduled to take place on July 29, has been marked as canceled in the Prozorro.Sales system.
Claims totaling 3.812 billion hryvnias, arising from decisions of the Zaporizhzhia Regional Commercial Court, were put up for auction. The lot included claims against the Russian state, represented by the Ministry of Justice of the Russian Federation, as well as a claim based on a court ruling regarding the joint and several liability of the state development corporation “VEB.RF.”
However, this story began much earlier. The “SY Zhnyva” agricultural enterprise, registered in Odesa, lost grain as a result of the occupation of parts of the Zaporizhzhia and Kherson regions. According to the company, Russian military forces looted or destroyed stocks of wheat, corn, and sunflower seeds worth nearly 3.8 billion hryvnias.
In 2023, the Commercial Court of Zaporizhzhia Oblast held Russia liable for the damages caused. Subsequently, the company filed a lawsuitagainst PJSC “Gazprom,” LLC “Gazprom Capital,” and Gazprom International Limited. In 2024, the court recognized these companies as alter egos of the Russian Federation and held them jointly and severally liable to compensate for the damages.
Afterward, “SY Zhnyva” sought to enforce the judgment in the Netherlands by filing a claim with the District Court of The Hague. However, in June 2025, the court refused to recognize and enforce the judgment, citing Russia’s state immunity.
Currently, the farm is undergoing bankruptcy proceedings, and its claim is up for sale. However, the second attempt to find a buyer for this asset has also failed.
