Illegal structures demolished on the coast of the Bug estuary by court order

The Mykolaiv District Prosecutor's Office has taken a series of measures aimed at practical enforcement of the decision of the Mykolaiv Oblast Commercial Court. Earlier, the court fully satisfied the prosecutor's claims and ordered a private business entity to return a land plot with a total area of 462 square meters located on Lazurna Street to the ownership of the territorial community.

This was reported by the Mykolaiv Regional Prosecutor's Office.

According to the court decision, the entrepreneur had to vacate the territory by completely dismantling all structures and the summer playground, bringing the land into a condition suitable for further intended use.

The reason for the intervention of the prosecutor's office and the subsequent court proceedings was that the entrepreneur used this plot of communal property without any proper legal grounds. A cafe with a summer terrace for visitors was illegally located on the seized territory. In addition to the absence of lease agreements or other permits, the situation was complicated by the location of the facility.

The disputed land is geographically part of the coastal protection zone of the Bug Estuary, which is clearly defined by regulations. Thus, conducting commercial activities there was a gross violation, as the land was used contrary to its environmental and designated purpose.

Despite the legal requirements and the existence of a court decision, the debtor refused to comply with it on a voluntary basis for a long period of time. The entrepreneur did not dismantle the structures on his own, which forced the initiation of enforcement proceedings. Within the framework of the enforcement proceedings, the law enforcement officers applied statutory enforcement measures to the violator to ensure the release of the city land.

As a result of consistent and coordinated actions, the illegal trade and recreation facilities were finally dismantled. As of today, the land plot on Lazurna Street has been completely cleared of illegal construction. It has been brought into proper condition, which allows the Mykolaiv community to use this coastal area in accordance with its legal status and the needs of its residents.
