High Council of Justice fails to dismiss judge from Odesa region in case of schemes for conscripts

The guilty verdict put an end to the career of Oleksandr Boyarsky, a judge from Odesa region, even before the disciplinary proceedings were completed. Because of this, the HCJ did not consider his dismissal.

This was reported by the press service of the High Council of Justice.

The High Council of Justice decided not to consider the motion to dismiss Oleksandr Boyarsky from the position of judge of the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast. The reason was that his powers as a judge had already been terminated due to the entry into force of the guilty verdict.

Back on February 3, 2025, the First Disciplinary Chamber of the HCJ brought the judge to disciplinary responsibility and submitted a motion for his dismissal. The reason was the judge's numerous decisions on determining the place of residence of children with their parents, which, according to the disciplinary body, were used in a scheme to evade mobilization of men of military age.

The Chamber identified 127 cases in which a judge ruled on determining the children's place of residence in favor of the parents in violation of the law. Such decisions were made without the participation of guardianship and custody authorities, without proper clarification of all the circumstances of the case and in an extremely short time frame. Later, this gave men the opportunity to apply for a deferral from mobilization and obtain the right to travel abroad under the pretext of raising their children on their own.

Oleksandr Boyarskyi , a judge of the Bilhorod-Dnistrovskyi City District Court , became a defendant in a corruption case in 2023. According to the investigation, he received a bribe for assistance in avoiding mobilization.

On January 12, the High Council of Justice authorized his detention. Already on January 16, 2024, the High Anti-Corruption Court imposed a measure of restraint on the judge in the form of arrest for two months with an alternative of bail of more than UAH 1 million.

In August 2025, the court found Boyarsky guilty of taking a bribe and sentenced him to six years in prison, but released him from serving his sentence with a probationary period of three years and banned him from holding certain positions during this time.

In addition, the judge agreed to allocate more than UAH 1 million of his bail to support the Ukrainian Defense Forces. The court also confiscated 20 thousand US dollars and 200 thousand hryvnias kept in his bank accounts.
