Court closes case of wife of deputy head of Odesa district council

The Prymorskyi District Court of Odesa has closed the case against Natalia, the wife of Oleh Radkovskyi, the first deputy head of the Odesa Regional Council from the Batkivshchyna party, for lack of administrative offense.

As stated in the court's ruling, on September 28, 2024, at 23:42, police officers stopped a Porsche Cayenne driven by Natalia Radkovska on Rishelievska Street.

The patrol officers thought that the woman was intoxicated - she smelled of alcohol, and she refused to undergo a medical examination for alcohol intoxication on the spot and in a medical facility.

According to the judges, in the video from the body cameras, the patrol police officer speaks about the alleged presence of the smell of alcohol from the car and offers to take a test, to which Natalia Radkovska convincingly claims that she did not drink alcohol, but does not express any refusal to take the test. Later, the patrol police officer asked her if she agreed to go to a medical facility located on Vorobyova Street to take a bioanalysis, to which she replied that it was the first time she had been accused of something she had not done.

Thus, according to the judges, the patrol police inspectors tried to provoke and push her to give an answer that would allow them to draw up an administrative report.

"Several times, the actual answer was 'that is, you refuse'. That is, the patrol police officer makes the conclusion he needs," the court noted.

In addition, at the end of the conversation, the police offered to drive to a medical facility and take a test, which, according to the judges, indicated their confidence in the driver's sobriety and the fact that she was charged on false grounds, given that there were no signs of alcohol intoxication, such as impaired coordination, impaired speech, etc, the video does not contain, the patrol officer stated that the smell was not from the mouth but from the car interior, which indicated that Natalia Radkovska had no signs of alcohol intoxication, and that the patrol officer's actions were erroneous and biased.
