Contractor ordered to return UAH 940 thousand to the budget of Kherson region

The Kyiv Commercial Court upheld the claim of the Oleshky District Prosecutor's Office, securing the recovery of UAH 945 thousand from a limited liability company in favor of the local budget.

This was reported by the Kherson Regional Prosecutor's Office.

Prosecutors found that when concluding a contract in 2023 for the construction of private houses in the village of Posad Pokrovske (Chornobaivska territorial community), the contractor unreasonably included value added tax in the cost of the work.

According to the Tax Code, works within the framework of programs for the restoration of housing destroyed as a result of hostilities are exempt from taxation. Nevertheless, the funds paid, which should have been returned to the budget, were withheld.

The prosecutor's office's appeal to the court was the basis for the return of these funds. This is the third lawsuit won in this category, and in general, similar cases worth more than 2 million are currently being considered in the commercial courts of Kyiv and Zaporizhzhia.

Earlier, Intent learned that contracts worth more than 800 million in Kherson region could go to only two contractors. Both companies have been repeatedly featured in journalistic investigations into the misappropriation of budget funds.

Three large-scale tenders for road maintenance and repair with a total expected value of almost UAH 800 million were announced in Kherson region. The customers are the Regional Infrastructure Restoration and Development Service and the state institution Local Roads of Kherson Region.

Only one bidder, European Road Construction Company LLC, one of the largest contractors in southern Ukraine, applied for the current repair of the Skhidne-Zahoryanivka road with an expected cost of over UAH 115 million. The company was established in 2008 in Donetsk under the name Altmost, and is currently owned by Muslim Keloyev.

Since 2018, the company has changed significantly and has begun to actively receive government contracts - for a total of more than UAH 7.9 billion, much of which was awarded without competition. In 2025, its earnings exceeded one billion hryvnias.
