Contract for repair of assembly and gymnasium of Kherson school challenged in court

In Kherson, the prosecutor's office tried to terminate the contract between the city's capital construction department and the contractor through the court. The case concerns the overhaul of a school in Kherson.

This is evidenced by the ruling of the Commercial Court of Odesa Oblast.

The court opened proceedings in a case concerning the overhaul of the premises of a Kherson school. It is a contract concluded in December 2021 for the repair of the assembly hall and gymnasium of school No. 52 on Krymska Street in Kherson.

The lawsuit was filed by the Kherson Regional Prosecutor's Office in the interests of the state. The plaintiffs include the Southern Office of the State Audit Service, Kherson City Council, and Kherson City Military Administration. The defendants in the case are the Capital Construction Department of the Kherson City Council and individual entrepreneur Mykhailo Yuzhnyi.

The prosecutor's office demands to terminate the legal relationship between the Capital Construction Department and the entrepreneur, which is related to the execution of the contract of December 9, 2021. It was under this contract that the overhaul of school premises was to be carried out.

The court concluded that the case was complex and should be considered under the rules of general action proceedings, rather than under a simplified procedure. The proceedings were officially opened on January 5, 2026.

The preparatory hearing was scheduled for February 17, 2026. The parties were given procedural deadlines for filing responses, answers and objections. The parties to the case were also informed of the possibility to participate in the hearing via video conference. The decision to open the proceedings has entered into force and is not subject to appeal.

According to the YouControl analytical system, Mykhailo Yuzhnyi has been in the status of termination since 2023. The main activity is the construction of residential and non-residential buildings. The sole proprietor participated in public procurement from 2019 to 2022.

The agreement in question, dated 09.12.2021, concerns the overhaul of the premises of the assembly hall and gymnasium of the Kherson Specialized School of I-III degrees No. 52 with in-depth study of the Ukrainian language of the Kherson City Council for UAH 2.6 million. According to the Prozorro procurement system, the contractor had to complete the work by December 31, 2022.

On February 1, 2022, the contract was amended. After adjusting the project documentation, the parties agreed to reduce the contract value by UAH 405,340. Also, due to the allocation of funds from the budget of the Kherson city community in 2022, they agreed to amend one of the clauses of the contract. In the YouControl system, the entrepreneur was paid UAH 295,851 under the agreement. In total, he has earned more than UAH 10.4 million from public tenders.

Also in Odesa, the case of embezzlement from the Kherson budget for garbage collection was resumed. Investigators insist on canceling the contracts and returning public funds due to violations of tender procedures. Law enforcers are asking to invalidate the agreement and recover more than UAH 3.8 million from the company. The agreement was concluded between the Department of Municipal Economy of Kherson City Council and Blahoustrii Kherson Plus.
