A resident of the Kherson region was unable to prove that he did not go to the TCC because of the shelling

In Kherson, a court found a man guilty of evading conscription during mobilization. He was sentenced to three years in prison for this offense.

This is stated in the court’s verdict dated September 7, 2026.

According to the case file, the man underwent a military medical examination in February 2025 and was deemed fit for service.

He then received a summons requiring him to report to the Territorial Recruitment and Social Support Center the following day.

However, the man did not appear at the center at the specified time. During the trial, he explained that this was due to a dangerous situation caused by shelling in Antonivka, where he lived.

To support the defendant’s argument that he failed to appear in response to the summons for valid reasons, the defense attorney submitted to the court letters from the Kherson City Council and the Kherson City Military Administration, the content of which indicates that on February 13, 2025, two shelling incidents were recorded in the village of Antonivka, that since August 2024, public transportation from Kherson to the village of Antonivka had been suspended, and that a curfew had been imposed in the settlements of the Kherson City Territorial Community from 8:00 p.m. to 6:00 a.m.

The judges ruled that the mere fact that the Kherson City Territorial Community—which includes the village of Antonivka—was classified as an active combat zone, as well as the fact that Antonivka was shelled in February, does not prove that it was impossible for the defendant specifically to arrive at the TCC.

At the same time, the court did not find any objective evidence confirming that, as of the relevant date, the defendant was actually residing in or present in the village of Antonivka. 

At the same time, the court found the prosecution’s evidence sufficient to establish guilt. The judges also took into account that the man had a prior criminal record.
