A court in Mykolaiv Oblast will hear a case regarding the refund of 116 thousand, which was paid without justification for fuel for educational institutions

<span><span><span><span><span><span>Following a lawsuit filed by the Bashtanka District Prosecutor’s Office, the Commercial Court of Mykolaiv Oblast will hear a case seeking to recover from a business entity and return to the budget overpaid funds totaling more than 116 thousand hryvnias. </span></span></span></span></span></span>

<span><span><span><span><span><span>The funds were paid under a contract for the purchase of gasoline and diesel fuel needed to support the operations of educational institutions under the Kazankivka Village Council. During the conclusion of the contract, three supplementary agreements were signed, under which the cost of gasoline and diesel fuel was unjustifiably increased and the supply volumes were reduced. Significant terms of the contract were unjustifiably altered, resulting in a violation of public procurement principles and non-compliance with the requirements of the Law of Ukraine “On Public Procurement.”</span></span></span></span></span></span>

<span><span><span><span><span><span>The contract between the company and the supplier was concluded on February 17, 2021. Neither the Department of Education, Youth, and Sports of the Kazankivka Settlement Council nor the settlement council itself filed claims seeking the return of the funds paid.  </span></span></span></span></span></span>

<span><span><span><span><span><span>The Bashtanka District Prosecutor’s Office also filed a lawsuit with the Commercial Court of Odesa Oblast seeking the return to the budget of 210,000 hryvnias unduly paid for the supply of natural gas to educational institutions. In this case, two additional agreements were signed, under which the cost of the resource was unjustifiably increased. </span></span></span></span></span></span>

<span><span><span><span><span><span>Previously, 155,000 hryvnias that had been overpaid for gasoline and diesel fuel for the community’s educational institutions were returned to the Bashtanka community budget through the courts. In that case, during the execution of the contract between the parties, six supplementary agreements were signed, which provided for an increase in the price of fuel and a reduction in the volume of its supply. </span></span></span></span></span></span>
